These Terms of Service ("Terms") govern your access to and use of the Tally mobile application for iOS (the "App") and the website at hellotally.app (the "Site"), together referred to as the "Service". The Service is operated by the Tally team ("Tally", "we", "us", or "our"). By installing the App or using the Site, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Tally is a personal finance application that helps you record transactions, set budgets, track recurring charges, and review your spending on iPhone. The Service is provided strictly as an informational tool. It is not a financial institution, an investment adviser, a tax adviser, or a legal adviser, and any output produced by the App, including any response from the in-app AI assistant, is intended for personal use only and should not be relied upon for binding financial, investment, tax, or legal decisions.
2. Eligibility
You must be at least 13 years of age (or the equivalent minimum age in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you further represent that you are authorized to bind that organization to these Terms.
3. Your account and data
Tally does not require you to create an account with us. The App stores your information locally on your device. You are solely responsible for securing your device, your Apple ID, and any backups you choose to maintain. We cannot recover data that is lost because of a lost or wiped device, an unrestored backup, or a deletion you performed. We strongly recommend keeping your device backed up via iCloud or another mechanism of your choice.
4. Subscriptions, billing, and trials
Access to Tally requires an active subscription, purchased through the App Store. The duration, price, and renewal cadence of the subscription are displayed to you in the App at the moment of purchase. By completing a purchase, you authorize Apple to charge the payment method on file with your Apple ID at the disclosed price, and you authorize Apple to continue charging that payment method at the same cadence until you cancel.
Where a free introductory period (a "trial") is offered, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel at least 24 hours before the trial ends. Cancellation is performed through your Apple ID account settings; we cannot cancel a subscription on your behalf. Refunds for App Store purchases are handled exclusively by Apple in accordance with their policies.
If you restore a previous purchase from the Settings or paywall screens, the App will reconcile your entitlement with Apple's records and re-enable access on that device. Restoring does not create a new charge.
5. Acceptable use
You agree to use the Service for lawful, personal purposes only. You may not reverse-engineer, decompile, or attempt to extract the source code of the App; use the App to plan, conduct, or assist illegal activity; impersonate another person or entity in the in-app AI assistant or feature request flows; submit content that is unlawful, defamatory, harassing, hateful, or that infringes the rights of others; or attempt to disrupt, overload, or otherwise interfere with our limited backend infrastructure, including the subscription verification, AI coach, and feature request services.
6. The AI coach
The Service includes an optional in-app assistant ("the AI coach") powered by a large language model. The AI coach can produce inaccurate, incomplete, or contextually inappropriate responses. You are responsible for any decision you take in reliance on its output. The AI coach is not a substitute for professional financial, investment, tax, or legal advice, and we make no representations or warranties about the accuracy or fitness for any purpose of the responses it produces.
7. Intellectual property
Tally, its name, logo, design, source code, written content, and all related intellectual property are owned by the Tally team and protected by applicable copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on iOS devices that you own or control, solely for your personal, non-commercial purposes, in accordance with these Terms and the App Store Terms and Conditions. All rights not expressly granted are reserved.
8. Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted use, and non-infringement. We do not warrant that the Service will be free from errors, interruptions, or data loss, or that any defects will be corrected.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Tally, its team members, or its providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, or any other intangible loss arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any direct damages arising out of or related to the Service will not exceed the greater of (a) the amount you paid to Apple for the App in the twelve (12) months preceding the claim, or (b) USD twenty (20).
10. Indemnification
You agree to indemnify, defend, and hold harmless Tally and its team members from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of any third party.
11. Termination
You may stop using the Service at any time by uninstalling the App and, if applicable, cancelling your subscription through your Apple ID. We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have breached these Terms or if continued provision of the Service to you would expose us to legal or reputational risk. Sections of these Terms that, by their nature, should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
12. Governing law and disputes
These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Madrid, Spain, except where mandatory consumer protection law in your country of residence provides otherwise.
13. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service, the law, or our practices. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will surface a notice in the App the next time you open it. Your continued use of the Service after the revised Terms take effect constitutes acceptance of the changes.
